DineshSharmaandothers)underSection4,21oftheMinesandMinerals(DevelopmentandRegulation)Act,19571read withRules3,57,70ofUttarPradeshMinorMinerals(Concession)Rules,19632andSections379,411IndianPenalCode3, PoliceStationChopan,DistrictSonebhadraarisingoutofCaseCrimeNo.274of2018pendinginthecourtofChiefJudicial Magistrate,Sonebhadra. 3.Theprincipalgroundwhichissoughttoberaisedinordertoraiseachallengetotheproceedingsisthattheprovisions underSections21and22oftheMinesandMinerals(DevelopmentandRegulation)Act,1957wouldoperateasabaragainst initiationofproceedingsbyregistrationofanFIRinrespectofallegationsconstitutingoffencesunderthePenalCode.Ithas beencontendedthattheapplicantcannotbeprosecutedandpunishedforthesameoffenceundertwoenactmentsnamely theMMDRActandtheIndianPenalCodeasthesamewouldbebarredbyapplyingtheruleagainstdoublejeopardy.Ithas beenfurtherurgedthatinrespectoftheoffence,ifatallcommitted,cognizancewouldhavebeentakenundertheMMDRAct, thattooonthebasisofacomplainttobefiledunderSection22byanauthorizedofficer. 4.LearnedAdditionalAdvocateGeneralsubmitsthatthebarunderSection22oftheActwouldapplyonlyinrespectof offencespunishableundertheMMDRActandnotinrespectofoffencesundertheprovisionsoftheIndianPenalCode.He accordinglysubmitsthattheinitiationofproceedingsbylodgingofanFIRcannotbesaidtobeprohibitedunderlaw.Further submissionisthattheFIRhavingbeenlodgedfordistinctoffencesunderthePenalCodeandMMDRAct,thereisnoillegality ininitiationofthecriminalproceedingspursuantthereto.ItispointedoutthattheStateGovernmenthasauthorizedallthe DistrictMagistrates/DistrictMinesOfficers,intheStateofUttarPradesh,forthepurposesofinitiatingprosecutionunder Section22oftheMMDRActandRule74oftheConcessionRules. 5.Thequestionwhichthusfallsforconsiderationiswithregardtothescopeandapplicabilityofthebarcontainedunder Section22oftheMMDRActandastowhethertheprovisionsunderthesectionwouldoperateasabaragainstinitiationof proceedingsalsoinrespectofoffencesunderthePenalCode.Theotherquestionwouldbeastowhatwouldbethestage whentheMagistratecanbesaidtohavetakencognizancesoastoattractthebarunderSection22oftheMMDRAct. 6.Inordertoappreciatetherivalcontentions,therelevantprovisionsundertheMMDRActmaybeadvertedto,andthesame areasfollows:- "4.Prospectingorminingoperationstobeunderlicenceorlease.(1)Nopersonshallundertakeanyreconnaissance, prospectingorminingoperationsinanyarea,exceptunderandinaccordancewiththetermsandconditionsofa reconnaissancepermitorofaprospectinglicenceor,asthecasemaybe,ofamininglease,grantedunderthisActandthe rulesmadethereunder: Providedthatnothinginthesub-sectionshalleffectanyprospectingorminingoperationsundertakeninanyareain accordancewiththetermsandconditionsofaprospectinglicenceorminingleasegrantedbeforethecommencementofthis Actwhichisinforceatsuchcommencement. Providedfurtherthatnothinginthissub-sectionshallapplytoanyprospectingoperationsundertakenbytheGeological SurveyofIndia,theIndianBureauofMines,theAtomicMineralsDirectorateforExplorationsandResearchofthe DepartmentofAtomicEnergyoftheCentralGovernment,theDirectorateofMiningandGeologyofanyStateGovernment(by whatevernamecalled),andtheMineralExplorationCorporationLimited,aGovernmentcompanywithinthemeaningof Clause(45)ofSection2oftheCompaniesAct,2013(18of2013),andanysuchentitythatmaybenotifiedforthispurpose bytheCentralGovernment. (1-A)Nopersonshalltransportorstoreorcausetobetransportedorstoredanymineralotherwisethaninaccordancewith theprovisionsofthisActandtherulesmadethereunder. (2)Noreconnaissancepermit,prospectinglicenceorminingleaseshallbegrantedotherwisethaninaccordancewiththe provisionsofthisActandtherulesmadethereunder. (3)AnyStateGovernmentmay,afterpriorconsultationwiththeCentralGovernmentandinaccordancewiththerulesmade 23/09/2021,17:10JUDGMENT/ORDERIN-APPLICATIONU/s482No.19576of2020atAllahabadDated-20.9.2021CASETITLE-RamBahalV… underSection18,undertakereconnaissance,prospectingorminingoperationswithrespecttoanymineralspecifiedinthe FirstScheduleinanyareawithinthatStatewhichisnotalreadyheldunderanyreconnaissancepermit,prospectinglicenceor mininglease. 21.Penalties.(1)Whoevercontravenestheprovisionsofsub-section(1)orsub-section(1-A)ofSection4shallbepunishable withimprisonmentforatermwhichmayextendtofiveyearsandwithfinewhichmayextendtofivelakhrupeesperhectareof thearea. (2)AnyrulemadeunderanyprovisionofthisActmayprovidethatanycontraventionthereofshallbepunishablewith imprisonmentforatermwhichmayextendtotwoyearsorwithfinewhichmayextendtofivelakhrupees,orwithboth,andin thecaseofacontinuingcontravention,withadditionalfinewhichmayextendtofiftythousandrupeesforeverydayduring whichsuchcontraventioncontinuesafterconvictionforthefirstsuchcontravention. (3)Whereanypersontrespassesintoanylandincontraventionoftheprovisionsofsub-section(1)ofSection4,such trespassermaybeservedwithanorderofevictionbytheStateGovernmentoranyauthorityauthorisedinthisbehalfbythat GovernmentandtheStateGovernmentorsuchauthorisedauthoritymay,ifnecessary,obtainthehelpofthepolicetoevict thetrespasserfromtheland. (4)Wheneveranypersonraises,transportsorcausestoberaisedortransported,withoutanylawfulauthority,anymineral fromanylandandforthatpurpose,usesanytool,equipment,vehicleoranyotherthing,suchmineral,tool,equipment, vehicleoranyotherthingshallbeliabletobeseizedbyanofficerorauthorityspeciallyempoweredinthisbehalf. (4-A)Anymineral,tool,equipment,vehicleoranyotherthingseizedundersub-section(4),shallbeliabletobeconfiscatedby anorderofthecourtcompetenttotakecognizanceoftheoffenceundersub-section(1)andshallbedisposedofin accordancewiththedirectionsofsuchcourt. (5)Wheneveranypersonraise,withoutanylawfulauthority,anymineralfromanyland,theStateGovernmentmayrecover fromsuchpersonthemineralsoraised,orwheresuchmineralhasalreadybeendisposedof,thepricethereof,andmayalso recoverfromsuchpersonrent,royaltyortax,asthecasemaybe,fortheperiodduringwhichthelandwasoccupiedbysuch personwithoutanylawfulauthority. (6)NotwithstandinganythingcontainedintheCodeofCriminalProcedure,1973(2of1974),anoffenceundersub-section(1) shallbecognizable. 22.Cognizanceofoffences.NocourtshalltakecognizanceofanyoffencepunishableunderthisActoranyrulesmade thereunderexceptuponcomplaintinwritingmadebyapersonauthorisedinthisbehalfbytheCentralGovernmentorState Government. 23-B.Powertosearch.IfanygazettedofficeroftheCentraloraStateGovernmentauthorisedbytheCentralGovernmentor aStateGovernment,asthecasemaybe,inthisbehalfbygeneralorspecialorderhasreasontobelievethatanymineralhas beenraisedincontraventionoftheprovisionsofthisActortherulesmadethereunderoranydocumentorthinginrelationto suchmineral;secretedinanyplaceorvehiclehemaybesearchforsuchmineral,documentorthingandtheprovisionsof Section100oftheCodeofCriminalProcedure,1973(2of1974),shallapplytoeverysuchsearch." 7.ThecorrespondingprovisionswithregardtocognizanceofoffencesundertheUttarPradeshMinorMinerals(Concession) Rules,1963,whichhavebeenmadeinexerciseofpowersunderSection15oftheMMDRAct,arealsorequiredtobe referredto.Rules3,57,70,74oftheConcessionRulesarebeingextractedbelow:- "3.Miningoperationstobeunderaminingleaseorminingpermit.-(1)Nopersonshallundertakeanyminingoperationsinany areawithintheStateofanyminormineralstowhichtheserulesareapplicableexceptunderandinaccordancewiththeterms andconditionsofaminingleaseorminingpermitgrantedundertheserules: Providedthatnothingshallaffectanyoperationsundertakeninaccordancewiththetermsandconditionsofaminingleaseor permitdulygrantedbeforethecommencementoftheserules. (2)Nominingleaseorminingpermitshallbegrantedotherwisethaninaccordancewiththeprovisionsoftheserules. 57.Penaltyforunauthorisedmining.-WhoevercontravenestheprovisionsofRule3shallonconvictionbepunishablewith imprisonmentofeitherdescriptionforaterm,whichmayextenduptosixmonthsorwithfinewhichmayextendtotwenty-five thousandrupeesorwithboth." 70.RestrictionontransportoftheMinerals.-(1)Theholderofaminingleaseorpermitorapersonauthorisedbyhiminthis behalfmayissueapassinFormMM-11toeverypersoncarryingaconsignmentofminormineralbyavehicle,animalorany othermodeoftransport.TheStateGovernmentmay,throughtheDistrictOfficer,makearrangementsforthesupplyofprinted MM-11Formbooksonpaymentbasis.
