IagreewiththedirectionsissuedbymylearnedbrotherK.T.Thomas,J.I,however,findmyselfunabletosubscribetotheviewthatputtingprisonertohardlabourandnotpayingwagestohimwouldbeviolativeofclause(1)ofArticle23oftheConstitutionandthisviolationissavedonlyunderclause(2)thereofwhichprovidesthatnothinginArticle23shallpreventtheStatefromimposingcompulsoryserviceforpublicpurposes.ThisisyetanotherdecisioninstringofdecisionsofthisCourtdealingwithprisonreformsandprisonadministration,lastonebeingRamaMurthyVs.StateofKarnataka(1997(2)SCC642)-judgmentdeliveredonDecember23,1996.InthecaseofRamaMurthythisCourtwhileconsideringvariousearlierdecisionsdealtwiththeproblemsofovercrowding,tortureandill-treatment,neglectofhealthandhygiene,insubstantialfoodandinadequateclothing,deficiencyincommunication,streamliningofjailvisits,managementofopenairprisonsanddelarintrialsofinmatesintheprisons.Afterlistingallthesecauss,thisCourtissueddirectionstotheStates,theUnionTerritoriesandtotheCentralGovernmentastowhytheyshouldnotactonthecausesdetailedinthejument.Noticeswereissuedtoshowcausewithinthmonthsandthematterhsbeenkeptforfurtherproceedings.ThecaseofRamaMuthyhsbeentaggedwiththecasesnowbeforeus,whichdealwiththequestionofwagespabletothprisonerssentencedtohlabour. StateofKeralaaggrievedbyjudgmentdatedApril13,1983ofDivisioinBenchoftheKeralaHighCOurt,soughtspecialleavetoappeal,whichwasgrantedbyorderdatedMay27,1983,andtghejudgmentstayed.BytheimpugnedjudgmenttheKeralaHighCourtgavethefollowingdirections:- "WethereforedirectthatforthwiththeGovernmentmakearrangementstopaytotheinmatesoftheprisons,whoareputtowork,wagesatRs.8/-perday,partofwhichtheymayutiliseforthemselves,partofwhichtheycouldarrangetoremittotheirdependentsandpartaccumulatedtobepaidtothematthetimeofrelease.Rule384oftheKeralaPrisonrulesmayneedimmediateattentioninthelightofthisJudgementandwehopetheGovernmentwilllookintoitforthwith."KeralaHighCourtwasconsideringthequestionofjustificationforgivingdirectionastowagestobepaidtotheprisonersinthejailsintheStateofkerala.Theissue,infact,waswhetherinlawtheclaimoftheprisonersinjailsforproperremunerationfortheworktheyarecompelledtodonotontheirownvolition,butbecauseofthecompulsionoftheprisonrulesisenforceablebytheCourt'smandate.HighCourtexaminedtheprovisionsofIndianPenalCode(IPC)-Sections53and55providingforrigorousimprisonment,whichisimprisonmentwithhardlabour.ItalsoexaminedtheTravancore-CochinPrisonsAct,1950,PrisonsAct(9of1894)andtheKeralaPrisonRules.TheseRules,itwouldappear,provideforpaymentofwagestotheprisoners,Underrule384,whichdealswithutilizationofwages,onethirdofthewagesearnedbytheprisonerismeantforhispersonalneedsinthejail,onethirdissenttothefamilyforitsneedandremainingonethirdforbeingpaidtotheprisoneronhisrelease.Onethirdtobeutilizedbytheprisonerinjail,isgiventohimintheeformofcouponsformakingpurchasesfromthejailcanteen.Hecouldalsopurchaseremissionforthewagessopaidtohim.Prisonerscentencedtosimpleimprisonmentaregivenworkonlyonthebasisoftheirrequestandsubjecttotheirphysicalfitness. OnthepleasraisedinthewritpetitiontheKeralaHighCourtframedthefollowingquestiontobeansweredbyitwhichitsaiditwascalledupontoconsiderinthiscase:- "Itaprisonerwhohastoundergohistermofsentenceinjailentitled,asofright,toclaimthatheshouldbepaidwagesforhisoutturnofwork?Isheentitledtoinsistthatthewagespaidshouldnotbeillusorybutreasonable?Canbecomplaintothiscourtthathispersonallibertyisinfringedandhisrightserodedbycompulsiontodohardlabourpracticallyfree?IsaCourtcalledupontograntreliefinsuchacase?Ifso,whatshouldbetheapproachoftheCOurtinthecircumstances?"Afterdetaileddiscussiononvariousaspectsincludingtheobjectofpunishment,thereformatorytheoryandothersuchaspectsincludingtheadvantagesofgivingfairwagestoprisonerstheHighCourtgavethedirectionsasaforesaid.ThecourtalsoexaminedtheprovisionsofArticle23oftheConstitutionwithreferencetodecisionofthiscourtinPeople'sUnionforDemocraticRightandothersVs.UnionofIndiaandothers
