WehavealsoheardSriNiteshAnand,alongwithSriSunitKumar,Advocate,onbehalfofResidentsWelfareAssociationofGardeniaGateway,Noida,whichclaimstohavefiledcaveatapplicationinthematter. Thepetitionershaveassailedthevalidityofacommunicationdated14.10.2020betweenGeneralManager(Planning),NoidaandSeniorManager(WorkCircle?VI),Noida.ThesaidinternalcommunicationbetweentwoauthoritiesofNoidamentionsthatonreceiptofcomplaintsfromtheresidentsofGardeniaGateway,Noida,variousnoticeswereissuedtothedeveloper(respondentno.3)fromtimetotime.Itspeaksaboutthedeveloperhavingnotcompliedwiththerequisiteformalitiestoobtainoccupancycertificatealbeitpossessionhavingbeenhandedovertotheallottees.Itfurthermentionsthatintheparkingarea,thereiswaterseepageandmalbahasbeendumped,resultingindifficultytotheresidentsinparkingtheirvehicles.Thedeveloperhasnotconstructedboundarywallinfrontofcommercialcomplex.Ithaderectedkiosksinsetbackarea.Itisalsoallegedthatmorethansanctionednumberofshopshasbeenconstructed.TheChiefExecutiveOfficerisstatedtohavepassedanorderon23.9.2020fordemolition.ThecommunicationrequiresthePlanningDepartmenttobeinformedsothatitsofficialsremainpresentalongwithsanctioned
